Employee Termination Letter

It may be good to enter into a formal employee termination letter when an employee resigns or departs from your company for cause or otherwise. An employee termination letter sets out the following provisions:

  • Reinforcing the confidentiality provisions
  • Reinforcing the non-compete provisions (if any)
  • Reinforcing the pre-departure obligations relating to handover and return of confidential documents

An employee termination letter does not need to be hostile (millennials tend to change jobs every 2 years!) – but provides an avenue for an employer and employee to discuss any potential post-termination surprises.
